2. Acceptance of Terms

By enrolling onto any programme provided by Transform Learning Academy, you confirm that you have read, understood, and agree to be legally bound by these Terms and Conditions.

These Terms constitute the entire agreement between you and Transform Learning Academy and supersede any previous discussions, representations, or agreements.

3. Eligibility and Enrolment

You must be aged 18 or over to enrol, unless parental or guardian consent has been obtained.

Your enrolment is confirmed once:

Payment has been received or an agreed payment plan is in place.
You have accepted these Terms and Conditions.

Transform Learning Academy reserves the right to refuse enrolment where reasonably necessary.

4. Programme Overview

The Business Analysis Programme may include:

Live Business Analysis training
BCS Foundation examination preparation
Online learning portal access
Project-based work experience
Group coaching sessions
Career coaching and job search support
One BCS Foundation examination sitting (where applicable)

We reserve the right to make reasonable amendments to programme delivery where necessary, provided the overall service remains substantially the same.

5. Payment Terms

Programme fees must be paid in full or via an agreed instalment plan.

Failure to maintain payments may result in:

Suspension of programme access
Removal from coaching sessions
Withdrawal of support services
Recovery action for outstanding balances

Any outstanding fees remain payable.

6. Cooling-Off Period

Under the Consumer Contracts Regulations 2013, you have the right to cancel within 14 days of purchase.

Where you request immediate access to programme materials, coaching, live training sessions, recordings, or support services during this period, you expressly consent to the commencement of services and acknowledge that your cancellation rights may be reduced or lost in accordance with applicable law.

7. Refund Policy

Following the expiry of the 14-day cooling-off period, programme fees are generally non-refundable except where required by law.

Refund requests must be submitted in writing to:

No refund will be issued where:

Services have been substantially delivered.
You have breached these Terms.
You have been removed due to misconduct.

Nothing in this policy affects your statutory consumer rights.

8. Student Responsibilities

Students agree to:

Attend training sessions where reasonably possible.
Complete coursework and project tasks.
Engage with coaching support.
Follow programme guidance.
Behave professionally and respectfully.

Failure to do so may impact programme progression and eligibility for the Money Back Guarantee.

9. Attendance and Conduct

Transform Learning Academy reserves the right to suspend or remove students who:

Engage in abusive, threatening, discriminatory, or disruptive behaviour.
Harass staff, coaches, students, or third parties.
Misuse programme systems or resources.

No refund will be provided where removal results from misconduct.

10. Programme Access

Programme access is typically provided for six (6) months from enrolment unless otherwise stated.

Additional access may be offered at our discretion and may incur additional charges.

11. Examination Policy

Where included, one BCS Foundation examination sitting is provided.

Any examination resits are the responsibility of the student unless otherwise stated.

12. Money Back Guarantee

The Money Back Guarantee is conditional and applies only where ALL of the following requirements have been satisfied:

Completion of 100% of the programme.
Attendance at the full 2-day live Business Analysis training.
Passing the BCS Foundation examination on the first attempt within six months.
Completion of all project tasks within the deadlines set by coaches.
Attendance at a minimum of one group coaching session per week.
Completion of at least 250 job applications within six months.
Full compliance with all job search guidance.
No missed or delayed payments.

Students must provide clear and verifiable evidence demonstrating compliance with all requirements.

The guarantee becomes void if any condition is not met.

A refund will not be available if the student secures a qualifying Business Analyst or related role, regardless of job title, where the duties substantially align with Business Analysis functions.

13. Reviews, Complaints and Feedback

Transform Learning Academy welcomes honest and genuine feedback.

Nothing in these Terms restricts your legal right to leave truthful reviews or express genuine opinions regarding your experience.

Students agree not to publish statements they know to be false, misleading, defamatory, or malicious.

Where concerns arise, students are encouraged to utilise our internal complaints procedure before escalating externally.

14. Intellectual Property

All programme materials, content, recordings, templates, frameworks, resources, and training materials remain the intellectual property of Transform Learning Academy.

Materials may not be copied, reproduced, shared, distributed, sold, or published without prior written consent.

15. Data Protection

We process personal data in accordance with:

UK GDPR
Data Protection Act 2018

Data is collected and processed for programme delivery, communication, administration, and legal compliance purposes.

16. Limitation of Liability

Nothing within these Terms excludes liability for:

Death or personal injury caused by negligence.
Fraud or fraudulent misrepresentation.
Any liability which cannot legally be excluded.

To the fullest extent permitted by law, Transform Learning Academy shall not be liable for indirect, consequential, or economic losses arising from participation in the programme.

17. Termination

We reserve the right to suspend or terminate programme access where a student:

Breaches these Terms.
Engages in misconduct.
Fails to maintain payment obligations.

18. Changes to These Terms

Transform Learning Academy may update these Terms from time to time.

Any material changes will be communicated to students where appropriate.

19. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales.

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
